II. Definition of terms

  • Customers are individuals and organizations that access, learn about, register, access, use products, services, utilities and/or have relationships/transactions on the website www.hobiverse.com.vn .
  • BVDLCN Terms means the Privacy Policy and Personal Data Protection Terms.
  • Personal data is information in the form of symbols, letters, numbers, images, sounds or similar forms expressed in the electronic environment associated with a specific person, including: full name, date of birth, gender, nationality, phone number, address, personal identification information and other relevant information.

III. General provisions

  1. This Privacy Policy and Terms of Service are an integral part of the payment process and the operations to Log In or Register on the Hobiverse website.
  2.   • Through contact, interaction with customers: via email, video call, call center, electronic communication or any other means.
  • Automatic recording: through cookies, plug-ins, third-party social media tools, and traffic data recording systems.
  • From other sources that the Customer agrees to share/provide or is required or permitted by law.

2. Purpose of processing personal data

Viet Tinh Anh may collect, use and process Customer's Personal Data for one or more purposes to improve the quality of products and services, better meet the needs and interests of Customers (hereinafter collectively referred to as 'Purpose'), including but not limited to the following purposes:

Verify, identify, and check the completeness and accuracy of information provided by Customers; assess and prevent risks related to counterfeiting, suspected counterfeiting, fraud or other illegal acts

  • Confirm and fulfill orders, provide after-sales service, and improve customer experience. Customer's order placement is understood as consent for Viet Tinh Anh to create customer account based on the information provided.
  • Providing, developing, managing, and measuring products, services, and utilities by Viet Tinh Anh.
  • Contact, take care of Customers, receive and process requests, instructions or feedback from Customers;
  • Promote, introduce and provide information to Customers related to products, services, promotional programs, surveys, market research or other trade promotion activities of Viet Tinh Anh, as well as products and services of partners cooperating with Viet Tinh Anh.
  • Conduct monitoring, inspection, auditing, risk management, information security, system security, compliance management and other internal activities according to Viet Tinh Anh's policies, as well as comply with requests from competent State agencies as prescribed by law.

Viet Tinh Anh will request explicit consent from the Customer before using the Customer's Personal Data for any purpose other than those stated in this policy.

3. Collection, Transfer and Disclosure of Personal Data

Viet Tinh Anh has been applying appropriate technical and organizational measures to protect personal data from unauthorized access, collection, use or disclosure from its service system.

Viet Tinh Anh commits not to trade, buy, sell, or illegally exchange Customer's personal information in any form. However, in order to carry out the purposes stated in this Policy, the Customer understands and agrees that Viet Tinh Anh may disclose Customer's Personal Data or Personal Data of third parties related to the Customer, to one or more of the following parties:

  • Viet Tinh Anh's personnel and internal departments for the purposes stated in Section IV, Part 2 of this Policy.
  • Stores, agents or member companies, affiliates, or related parties of Viet Tinh Anh;
  • Partners, strategic partners, service providers, or entities affiliated with the above purposes, including in the process of providing independent or integrated products and services of Viet Tinh Anh;
  • Competent state agencies as prescribed by law; or individuals and organizations with functions such as lawyers, notaries, auditing units, credit rating organizations... when necessary in specific cases and in accordance with the provisions of law;
  • Other third parties with the Customer's separate consent, or in cases where Viet Tinh Anh has a legal basis to share Customer's Personal Data as prescribed by law.

Viet Tinh Anh considers Customer's Personal Data as private and confidential information. Except for the cases stated above, Viet Tinh Anh commits not to disclose Customer's Personal Data to any other third party.

V. Implementation of Customer's rights and obligations related to Personal Data

  1. Customers have the following rights: (i) Right to know; (ii) Right to consent; (iii) Right to access; (iv) Right to withdraw consent; (v) Right to delete data; (vi) Right to restrict data processing; (vii) Right to provide data; (viii) Right to object to data processing; (ix) Right to complain, denounce, and file a lawsuit; (x) Right to request compensation for damages; (xi) Right to self-defense and other related rights as prescribed by law.
  2. Viet Tinh Anh will, using reasonable efforts, comply with a valid and lawful request from the Customer within the legally prescribed time period from receipt of a complete, valid request and the relevant processing fee (if any) from the Customer, subject to Viet Tinh Anh's right to invoke any exemptions and/or exceptions as provided by law.
  3. In the event that the Customer withdraws his/her consent, requests data deletion and/or exercises other relevant rights with respect to any or all of the Customer's Personal Data, and depending on the nature of the Customer's request, Viet Tinh Anh may consider and decide not to process the Customer's request or not to continue providing Viet Tinh Anh's products and services to the Customer due to (i) legal regulations and/or competent authorities not allowing Viet Tinh Anh to perform such activities or (ii) the standard/quality of the product/service cannot be guaranteed if such data is deleted/restricted or (iii) legal regulations require Viet Tinh Anh to collect the Customer's personal data when providing products and services or (iv) other cases in Viet Tinh Anh's assessment that deleting/restricting data may disrupt the structure and infrastructure of protecting the Customer's historical information data.
  4. Customers are responsible for protecting their own Personal Data and requesting other relevant organizations and individuals to protect their Personal Data. At the same time, Customers must also respect and protect the Personal Data of others.
  5. Implement and comply with the provisions of law on Personal Data protection and participate in preventing and combating violations of regulations on Personal Data protection.
  6. In case of any changes or adjustments to Personal Data, the Customer is responsible for accessing the Hobiverse website to proactively check and update Personal Data or contact and immediately notify Viet Tinh Anh so that Viet Tinh Anh can promptly update such changes or adjustments. The Customer will be fully responsible for any delay in updating or delay in notifying Viet Tinh Anh to update such Personal Data.

VI. Protection measures and risks of Personal Data disclosure

  1. Viet Tinh Anh always values ​​privacy and strives to secure and ensure the safety of Customers' Personal Data as the most important asset of Viet Tinh Anh and Viet Tinh Anh always strives to ensure confidentiality, safety, compliance with the law, and limit unwanted consequences and damages that may occur. Viet Tinh Anh fulfills its responsibility to protect Personal Data in accordance with current laws with appropriate security methods according to legal regulations, market practices and regularly reviews and updates management and technical measures when processing Customers' Personal Data (if any).
  2. The Customer understands that providing and accepting Viet Tinh Anh to use and process Personal Data will always have potential risks such as the risk of partial Data leakage or inappropriate and untimely data processing, which may arise from causes such as: system errors, transmission lines, force majeure events, viruses, network attacks or hardware and software errors, actions and operations of the Customer or any other third party affecting the provision and processing of the Customer's Personal Data, etc.

VII. Processing and Storage Time of Personal Data

  1. The time for processing personal data does not depend on the time when the Customer initiates a transaction with Viet Tinh Anh through the Hobiverse website and/or terminates/stops using the products, services or contracts, agreements established between the two parties. This Privacy Policy and Terms of Service remain in effect from the time the Customer's Personal Data is recorded on the Hobiverse website system until the Purposes of processing personal data in Section IV are completed or the cases of termination of personal data processing are in accordance with the law.
  2. Customer's personal data collected and stored by Viet Tinh Anh will be kept confidential. Viet Tinh Anh commits to implementing reasonable technical measures to ensure safety and prevent unauthorized access, use, disclosure or alteration of stored personal data.

VIII. Effectiveness, notification and amendments

  1. When using any product, service or accessing the Hobiverse website, the Customer is deemed to have agreed and accepted all of the Privacy Policy and Terms of Service. In case the Customer does not agree with the content of the Privacy Policy and Terms of Service, the Customer has the right to send a written notice to Viet Tinh Anh to request termination of use of the service, product or stop accessing the Hobiverse website.

    If after sending the termination notice, the Customer continues to use the product, service or access the Hobiverse website, it is understood that the Customer has withdrawn his/her objection and agreed to this BVDLCN Policy and Terms.
  2. Viet Tinh Anh has the right to amend, update or adjust the content of the Privacy Policy and Terms of Service from time to time, and at the same time ensure that the amendments and supplements are in accordance with current legal regulations.
