MY POINTS MEMBERSHIP PROGRAM TERMS & CONDITIONS

Chapter 1: My Points Membership Program Rules

Article 1: Purpose

– Members accumulate points through purchasing products at chains participating in the My Points program and can use the accumulated account to purchase products and services at stores participating in the program.

– Members provide their registered member account information (Phone number/Email) to receive new promotional information (if any) and enjoy My Points promotions exclusively for members.

– The purpose of all terms is to stipulate all rights, obligations of members and procedures for members to use the loyalty membership policy provided by My Points.

Article 2: Definitions

– Members are customers who accept the program terms and register information to become members of the My Points program, collectively referred to as members.

– Membership policies are care policies built by My Points specifically for members and are collectively referred to as policies.

– Member account is the member's point accumulation account. Each member has only 01 (one) account, the account will be verified based on/ based on ID card/ CCCD/ Passport.

– Points are the unit of calculation of member spending transactions accumulated in the account.

– Accumulated spending is the amount of money a member has spent on products or services at Mykingdom, Hobiverse, Clever Collection chains within the 12-month rating period according to My Points regulations and is used to evaluate Membership Rank.

– Membership rank is the rank that members are recognized based on the number of points that members have accumulated according to regulations. There are 03 (three) membership ranks: Silver, Gold and Diamond. Depending on the total amount of spending by members at My Points and partner brands, the Membership Rank may be changed.

– Accumulated Points are points that members accumulate at a rate determined and announced by My Points when members purchase products or services from My Points and members can use these points to purchase products or use services at Mykingdom, Hobiverse, Clever Collection that participate in the program.

Article 3: Membership Policy

Preferential policies for members according to the following mechanism:

- Accumulated spending: After purchasing products or using services at Mykingdom, Hobiverse, Clever Collection chains, members will accumulate according to regulations and will rely on ranking points to decide the Membership Level and the preferential mechanism that members will receive (the rate will be accumulated after VAT, after deducting promotional incentives and after deducting accumulated points used).

- Accumulate and use Accumulated Points: Members can use them to purchase products or use services at chains participating in the My Points program, according to My Points regulations.

- Promotional program (For all members or by membership level): Members can use promotions offered by My Points and announced on communication channels decided by My Points.

Article 4: Subjects and conditions for membership registration

4.1 Subjects

– All customers aged 18 and over can become members of My Points. Customers will register for membership at Mykingdom, Hobiverse, Clever Collection stores or on the Mykingdom website by filling in the required information that My Points has specified and agreeing to the terms of acceptance regarding the collection and use of personal information.

– Members are not allowed to transfer or assign their membership to a third party and cannot use it as collateral.

4.2 Registration conditions

– Customers register for a free membership account at Mykingdom, Hobiverse, Clever Collection stores and the Mykingdom website.

– Customers must provide correct and complete personal information (Phone number, full name are required information by My Points when registering an account to become a member).

– Each individual can only create one account. New members will receive a verification message via the registered phone number to successfully activate the account.

Article 5: Scope of use

– Mykingdom, Hobiverse, Clever Collection.

– Mykingdom website.

– Viet Tinh Anh's partners in the business process.

Article 6: Use and Management of Member Accounts

– Members must provide their account information to accumulate before payment invoice is issued.

– Member accounts may not be transferred, assigned or authorized to be used by a third party or used as collateral without the prior consent of My Points.

– When members use promotions, accumulated points, services or change personal information, My Points has the right to request members to present their ID card for confirmation.

– My Points is not responsible for any damage to members due to members' violation of regulations, or due to members' carelessness in managing their member accounts.

– If a member account is lost or suspected of being stolen, please notify My Points immediately for assistance. My Points will not be responsible for any loss that occurs before the member makes the notification and My Points records the problem on the system.

Article 7: Membership Ranking Criteria

7.1 Rating cycle

– The member's rating cycle is 12 months from July 7, 2022.

– The rating cycle starts on July 7th every year.

For example:

– Members who register on May 1, 2023 will be considered for Membership Level on July 7, 2023 based on accumulated spending from May 1, 2023 to July 6, 2023.

– For members who register on June 15, 2022, the ranking period will be from July 7, 2022 to July 6, 2023. During this time, the amount of accumulated spending that members accumulate will be determined by the corresponding limit and will be considered for Membership Rank according to Accumulated Spending.

7.2 Ranking Regulations

– Members will accumulate points after purchasing products or using services at retail chains participating in the My Points program according to regulations.

– The minimum total spending required to be accumulated in each rating period for each Membership Level is as follows:

From 07/07/2022 to 06/07/2023, if the member's total spending reaches from:

– Unlimited number of accumulations.

– The system will automatically accumulate 100% of the Member Payment Invoice Value into the account (after VAT and after deducting promotional incentives) & will update the customer account after 3 working days from the time the customer purchases the order, starting from July 7, 2022.

7.3 Promotion, retention and demotion.

– As soon as a member accumulates enough spending according to My Points regulations, after 3 working days the Membership Rank will be upgraded to the corresponding rank.

– To maintain the rank, Members need to accumulate minimum spending according to the My Points ranking regulations within 12 months from the start date 07/07/2021.

– If a member fails to meet the maintenance requirements, the Membership Rank will be downgraded according to the respective ranking conditions.

Members with no spending in the 12 months before their 30-day birthday: continue spending to level up and enjoy great benefits.

Members with spending in the 12 months before their birthday 30 days under 5 million VND: -30% up to 200,000 VND

Members with spending in the 12 months before their birthday 30 days from 5 million VND: -30% up to 500,000 VND

Members with spending in the 12 months before their birthday 30 days from 15 million VND: -30% up to 1,000,000 VND

8.1.1 Point accumulation form

- Accumulated points will be valid after 3 days from the date the customer purchases the order.

- The number of Accumulated Points will be accumulated according to the preferential level of each level on the total value of the payment bill into the member account (after VAT, after deducting the accumulated points used and after deducting promotional incentives).

- Unlimited number of accumulations.

- 1 point is worth 1 VND when paying. (1 point = 1 VND).

For example:

- Silver members spend 1st time: 500,000 VND - accumulate 1% = 5,000 points (after 3 days).

- Members continue to spend for the second time: 560,000 VND - accumulate 1% = 5,600 points (after 3 days).

- Total Accumulated Points: 10,600 points 🡪 Not enough to use.

- Members continue to spend for the 3rd time: 5,000,000 VND - accumulate 1% = 50,000 points (after 3 days).

- Total Accumulated Points: 60,600 points.

- Total accumulated points that can be used: 60,600 VND. And upgraded to Gold Rank.

- Accumulated points are valid until March 31 of the following year.

8.1.2 Conditions for applying incentives

- Only applicable to members who come directly to use at the list of stores participating in the My Points program or the Mykingdom website (No accumulated delivery costs).

- Each member who scans the QR code for the first time will receive a gift with an expiration date clearly stated in the message content.

Each member will receive the following birthday benefits:

- Register or update 30 days before your birthday.

- Members can register birthdays for themselves, their children or others (if any), but can only receive a maximum of 1 offer/member/year.

- Each member when upgrading will receive special gift incentives according to each level.

- In case the accumulated amount is subject to tax or other fees and charges as prescribed by the competent authority, such tax, fee and/or charge shall be borne by the member.

Article 9: Withdrawal and cancellation/lock of membership

Any member, at any time, may request to withdraw their membership in writing, by text message or by any other means as prescribed by My Points and My Points will assist in processing the withdrawal of membership upon the member's request.

My Points reserves the right to cancel/lock membership when any of the following events occur:

– Registration information is incorrect/not authentic.

– Applying/using the program in an illegal manner or for inappropriate purposes such as accumulating and using accounts incorrectly.

– Members are involved in prohibited cases or cases contrary to public order and customs such as preventing other members from using the My Points website or My Points application or abusing related information from other websites or violating the obligations stipulated in this document.

The withdrawal of membership or cancellation/blocking of membership as prescribed will take effect on:

– The date the member requests to withdraw membership.

– The date the member receives the notification of cancellation/lock of membership.

Article 10: Account processing when withdrawing membership

– When a Member requests to withdraw their membership, if the Member does not use up all the accumulated points, all points will automatically expire.

– When a Member is canceled/locked according to regulations, the accumulated points will automatically expire.

Article 11: Change or Termination of Membership Policy

– My Points has the right to change the structure and terms of the membership policy or terminate the membership policy in part (01) or terminate the entire program without prior notice and will notify Members through any My Points media (Website, Zalo OA, ….).

– Members will not be entitled to all membership policy benefits after the date My Points has announced and specified.

 

Chapter 2: My Points Privacy Notice

Article 1: Collection of members' personal information data

The member information My Points collects includes:

  • Full Name
  • Date of birth of member and member's children
  • Phone number
  • E-mail
  • Gender of member, member's child, expected date of birth of baby (for products for pregnant mothers)

Article 2: Sharing member information to third parties

– This information will be shared with partners when My Points executes contracts and agreements related to the use of member data.

– The third party is responsible for fully implementing the regulations on responsibility for processing personal data according to the provisions of the Law.

Article 3: Principles of protecting members' personal data

– Members' personal data is processed in accordance with the law.

– Members are informed about activities related to the processing of their personal data, unless otherwise provided by law.

– Members' personal data will only be processed for the purposes registered by My Points, declared on personal data processing.

– The personal data of members collected must be appropriate and limited to the scope and purpose of processing. Personal data cannot be bought or sold in any form, unless otherwise provided by law.

– Members' personal data is updated and supplemented in accordance with the processing purpose.

– Members' personal data are protected and secured during processing, including protection against violations of personal data protection regulations and prevention of loss, destruction or damage due to incidents, using technical measures.

– Personal data is only stored for a period consistent with the purpose for which the data is processed, unless otherwise provided by law.

– My Points is responsible for complying with the data processing principles and demonstrating its compliance with those data processing principles.

Article 4: Members' rights to data

– Right to know: Members are informed about the processing of their personal data, unless otherwise provided by law.

– Right to consent: Members may consent or not consent to the processing of their personal data, except in the cases specified in Article 13 of these Regulations.

– Right of access: Members have access to view, edit or request correction of their personal data, unless otherwise provided by law.

– Right to withdraw consent: Members have the right to withdraw their consent, unless otherwise provided by law.

– Right to data deletion: Members have the right to delete or request deletion of their personal data, unless otherwise provided by law.

– Right to restrict data processing:

  • Members are required to restrict the processing of their personal data, unless otherwise provided by law.
  • Restriction of data processing is carried out within 72 hours of the member's request, with all personal data that the Member requests to be restricted, unless otherwise provided by law.

– Right to data provision: Members are entitled to request My Points to provide them with their personal data, unless otherwise provided by law.

– Right to object to data processing:

  • Members may object to My Points processing their personal data to prevent or restrict the disclosure of personal data or use for advertising or marketing purposes, unless otherwise provided by law.
  • My Points will process member requests within 72 hours of receiving the request, unless otherwise provided by law.

– Right to complain, denounce, and sue: Members have the right to complain, denounce, or sue according to the provisions of law.

– Right to request compensation for damages: Members have the right to request compensation for damages according to the provisions of law when there is a violation of regulations on the protection of their personal data, unless the parties have another agreement or the law provides otherwise.

– Right to self-defense: Members have the right to self-defense according to the provisions of the Civil Code and other relevant legal provisions, or request competent agencies and organizations to implement methods to protect civil rights according to the provisions of the Civil Code.

Article 5: Member's obligations regarding data

– Protect your personal data yourself; request other relevant organizations and individuals to protect your personal data.

– Respect and protect the personal data of others.

– Provide complete and accurate personal data when agreeing to allow the processing of personal data.

– Participate in promoting and disseminating personal data protection skills.

– Comply with legal regulations on personal data protection and participate in preventing and combating violations of regulations on personal data protection.

Article 6: Member's consent

– The member's consent applies to all activities in the personal data processing process, unless otherwise provided by law.

– The member's consent is only valid when the member voluntarily and clearly understands the following contents:

  • Types of personal data processed.
  • Purpose of processing personal data.
  • Organizations and individuals whose personal data is processed.
  • Rights and obligations of members.

– The member's consent must be clearly and specifically expressed in writing, voice, checking a consent box, text message consent syntax, selecting technical consent settings or through another action that demonstrates this.

– Consent must be for the same purpose. When there are multiple purposes, My Points must list the purposes so that the member agrees to one or more of the stated purposes.

– The member's consent must be expressed in a format that can be printed, reproduced in writing, including in electronic form or verifiable format.

– Silence or non-response of a member shall not be deemed as consent.

– Members may agree in part or with conditions attached.

– For the processing of sensitive personal data, the member must be informed that the data to be processed is sensitive personal data.

– The member's consent is effective until the member decides otherwise or until a competent state agency requests in writing.

– In case of dispute, the responsibility to prove the member's consent lies with My Points.

– Through authorization as prescribed by the Civil Code, My Points can carry out procedures related to the processing of members' personal data on behalf of members, unless otherwise provided by law.

Article 7: Withdrawal of consent

– Withdrawal of consent does not affect the lawfulness of the processing of data for which consent was granted prior to withdrawal of consent.

– The withdrawal of consent must be expressed in a format that can be printed, reproduced in writing, including in electronic form or verifiable format.

– When receiving a request to withdraw consent from a data subject, My Points must notify the data subject of the consequences and possible damages that may result from withdrawing consent.

– After withdrawing consent, My Points must stop and request relevant organizations and individuals to stop processing the data of the data subject who withdrew consent.

Article 8: Commitment to collecting personal information and protecting members' personal information

– My Points will collect members' personal information from the information members provide and the information required when registering for a membership account.

– My Points has the right to synthesize information and use it for marketing activities to provide programs to better care for members.

– Personal information that My Points collects from Members is the identifying information provided by the member in the registration form such as Phone Number, Email, full name, date of birth, birth certificate photo, and transaction information that My Points collects when the Member uses it.

– My Points commits to keep members' personal information absolutely confidential according to the personal information protection policy. The collection and use of each member's information is only done with the consent of that member, except in cases where the law provides otherwise.

My Points does not use, transfer, provide or disclose to any third party any member's personal information without the member's permission or consent, except in the following cases:

– Where minimal information (Full name, phone number and email) is required to be disclosed to provide the service provider

– Where personal information is disclosed for statistical, research or marketing purposes, provided that such information is disclosed in a form that cannot identify any specific person; or where personal information is disclosed as required by law.

Article 9: Right to adjust Member's personal information

- Member:

+ Have access to view and edit your personal data after it has been collected by My Points with your consent, unless otherwise provided by law.

+ In case direct editing is not possible due to technical or other reasons, members have the right to request My Points to edit their personal data.

– My Points will edit the member's personal data after receiving the individual member's consent as soon as possible or as required by law. In case it is not possible to do so, it will notify the member within 72 hours of receiving the member's request to edit personal data.

– When a member has any personal information that needs to be changed, please provide relevant images/documents to My Points for support and My Points will not be responsible for any damage arising from the Member's carelessness.

– Upon receiving information from a member (cancellation or correction of information), My Points will process it within seven (07) working days.

Article 10: Storage, deletion and destruction of personal data

– Members have the right to request My Points to delete their personal data in the following cases:

  • Recognizing that it is no longer necessary for the purpose for which it was collected, consented and accepted the possible damages when requesting deletion of data.
  • Withdraw consent.
  • Object to the processing of data and My Points has no legitimate reason to continue processing.
  • The personal data is processed inconsistently with the agreed purpose or the processing of the personal data is in violation of the law.
  • Personal data must be deleted as required by law.

– Data deletion will not apply upon request of the data subject in the following cases:

  • The law does not allow data deletion.
  • Personal data is processed by competent state agencies for the purpose of serving the activities of state agencies as prescribed by law.
  • Personal data has been disclosed in accordance with the law.
  • Personal data is processed to serve legal requirements, scientific research, and statistics as prescribed by law.
  • In case of emergency regarding national defense, security, social order and safety, major disasters, dangerous epidemics; when there is a threat to national security and defense but not to the extent of declaring a state of emergency; preventing and combating riots, terrorism, preventing and combating crimes and violations of the law.
  • Respond to an emergency situation that threatens the life, health or safety of a data subject or other individual.

– In case My Points is divided, separated, merged, consolidated or dissolved, personal data will be transferred in accordance with the law.

– Data deletion is performed within 72 hours of the data subject's request for all personal data collected by My Points, unless otherwise provided by law.

– My Points stores personal data in a form appropriate to its operations and takes measures to protect personal data in accordance with the law.

– Deleted My Points cannot be recovered in the following cases:

  • Processing of data is not in accordance with the purpose or the purpose of processing of personal data for which the data subject has consented has been fulfilled.
  • The storage of personal data is no longer necessary for the operation of My Points.
  • My Points is dissolved or no longer operating as required by law.

– The collected birthday information of members will be stored during the time the membership account is valid. Members who have withdrawn their membership or whose membership is canceled will be deleted and canceled after the time specified by My Points.

– In cases where the law requires, the company is required to retain personal information for a certain period of time for purposes such as identifying details of Member transactions. My Points has the right to retain collected personal information for the period prescribed by relevant laws.

Article 11: Processing of personal data without the consent of the member

– In case of emergency, it is necessary to immediately process the relevant personal data to protect the life or health of the data subject or another person. My Points is responsible for proving this case.

– Disclosure of personal data as prescribed by law.

– Data processing by competent state agencies in case of emergency regarding national defense, security, social order and safety, major disasters, dangerous epidemics; when there is a threat to national security and defense but not to the extent of declaring a state of emergency; preventing and combating riots, terrorism, preventing and combating crimes and violations of the law according to the provisions of law.

– To perform the data subject's contractual obligations with relevant agencies, organizations and individuals as prescribed by law.

- Serving the operations of state agencies as prescribed by specialized laws.

Article 12: Processing of personal data of persons declared missing or dead

– Processing of personal data relating to personal data of a person declared missing or deceased must have the consent of that person's spouse or adult child. In the absence of these persons, the consent of the parent of the person declared missing or deceased must be obtained.

– In the absence of all the above mentioned persons, it is considered that there is no consent.

Article 13: Processing of children's personal data

– Processing of children's personal data is always carried out in accordance with the principle of protecting the rights and in the best interests of the child.

– The processing of children's personal data must have the consent of the child in the case of children aged 7 years or older and with the consent of their parents or guardians as prescribed. My Points must verify the age of the child before processing the child's personal data.

– Stop processing children's personal data, irreversibly delete or destroy children's personal data in case of:

  • Processing of data for purposes other than those for which the data subject has consented or for which the purpose of processing of personal data has been fulfilled, unless otherwise provided by law.
  • The child's parent or guardian withdraws consent to the processing of the child's personal data, unless otherwise provided by law.
  • At the request of competent authorities when there is sufficient basis to prove that the processing of personal data affects the rights and legitimate interests of children, except where otherwise provided by law.

Article 14: Protection of personal data in marketing services and advertising product introduction business

– Only use personal data of members collected through business activities of Viet Tinh Anh Joint Stock Company for marketing services and advertising product introduction with the consent of the data subject.

– Processing of members' personal data for marketing services and advertising product introduction must have the consent of the member, on the basis that the customer clearly knows the content, method, form and frequency of product introduction.

– Responsible for proving that the use of personal data of customers introduced to products is in accordance with the above regulations.

Article 15: Illegal collection, transfer, purchase and sale of personal data

– My Points must apply personal data protection measures to prevent unauthorized collection of personal data from its systems and service equipment.

– Setting up software systems, technical measures or organizing activities to collect, transfer, buy and sell personal data without the consent of the data subject is a violation of the law.

Article 16: Notification of violations of regulations on personal data protection

– In case of detecting a violation of personal data protection regulations, My Points must notify the Ministry of Public Security (Department of Cyber ​​Security and High-Tech Crime Prevention) no later than 72 hours after the violation occurs. In case of notification after 72 hours, the reason for the late notification must be included. The contact point of Viet Tinh Anh Joint Stock Company sending the violation notification to the Ministry of Public Security is the Information Security Department - Head of the Legal Department.

– My Points must notify the contact person of Viet Tinh Anh Joint Stock Company, Mr. Le Quoc Huy – Head of Legal Department, as soon as possible after noticing a violation of personal data protection regulations.

– Content of notification of violation of regulations on personal data protection:

  • Describe the nature of the violation of personal data protection regulations, including: time, location, behavior, organization, individual, types of personal data and amount of data involved.
  • Contact details of the employee assigned to data protection or the organization or individual responsible for protecting personal data.
  • Describes the consequences and possible damages of violating personal data protection regulations.
  • Describe the measures taken to address and mitigate the harm caused by breaches of personal data protection regulations.

– In case it is not possible to fully notify the above regulations, the notification can be done in batches and stages.

– The Head of the Legal Department shall draw up a record confirming the occurrence of a violation of personal data protection regulations and coordinate with the Ministry of Public Security (Department of Cyber ​​Security and High-Tech Crime Prevention) to handle the violation.

– The Head of the Legal Department shall notify the Ministry of Public Security (Department of Cyber ​​Security and High-Tech Crime Prevention) when detecting the following cases:

  • Detecting violations of the law on personal data.
  • Personal data is processed for purposes other than those agreed upon initially between the data subject and My Points or in violation of the provisions of the legal entity.
  • No guarantee of data subject rights or enforcement.
  • Other cases as prescribed by law.

Article 17: Authorization to process and manage personal information

– In principle, My Points will carry out activities related to the processing and management of personal information collected from Members. If necessary, My Points has the right to appoint a third party to carry out all or part of the processing and management of this personal information.

– My Points is responsible for maintaining a security system to protect members' personal information.

Article 18: Purpose of using personal information

– Used to confirm orders when customers want to buy any product on the website or mini-app Zalo My Points.

– Used to send notifications, carry out advertising and PR programs for new services used on the website.

– Provide service information by email.

– Used to analyze customer consumption trends, with the aim of building new services, or improving old services.

– Used to contact customers when we investigate customer information, organize promotions, exchange information and opinions on review and comment boards.

– Used to answer customer inquiries: we will respond to customers by email, phone, or send a letter to the customer's address when the customer has an inquiry.
